PRIVACY STATEMENT Introduction Your privacy is very important to us at CAE. This Privacy Statement explains what information we receive about you, how it may be used and how this information is protected by CAE. This Privacy Statement and the policy reflected herein are issued to comply with EU General Data Protection Regulation (EU) 2016/679 of April 27, 2016 ("GDPR") and any relevant national implementing legislation (together the "Regulations"). Personal data CAE collects and uses certain personal data received either directly from you or indirectly (e.g. via authorities, social security agencies or training service provider) in relation to your employment or engagement. Typically, the personal data that CAE may process in this respect includes your name, address, contact details, banking and tax information, nationality, date of birth, identity card or passport details, photos, flight licences, medical licences, security clearance, training requirements, training performance and grading data. Under the Regulations, some of this data is regarded as special category personal data (e.g. health information). CAE facilities (including CAE group training facilities) are, as a rule, equipped with CCTV or video surveillance systems and with an entry registration and security system. Processing and its purposes CAE uses personal data collected in order to properly execute your contract. CAE therefore collects, uses, administers, records, transfers and stores ("Processes") personal data in order to effectively perform these agreed mutual contractual obligations. Among other things, CAE may also Process personal data: • To perform, manage and/or maintain your employment or engagement relationship; • To facilitate and improve training related to your employment or engagement; • For accounting and payment processing; • To manage communication and transactions; • To answer queries or complaints; • To carry out analyses and research; • To perform analytic services to evaluate and examine patterns in training performance to help improve relevant training curriculum. CCTV or video recordings are made to detect, record and deter illegal behaviour and unlawful acts. Access registration data is processed for visitor management and access control, if necessary. CAE also processes data to comply with applicable laws, e.g. export control regulations, aviation regulations (such as validity of flight and medical licences, engineering licences and security clearance) and generally for any other purpose that is necessary or related to the relationship between CAE and you. All of the above are collectively referred to as "Purposes". The processing of personal data is considered necessary to protect the legitimate interests of CAE (and airline operators where relevant) in accordance with applicable legislation and having duly taken into account your interests. CAE processes your personal data only in accordance with the Regulations including any applicable guidelines and amendments. CAE reserves the right to update and amend this Privacy Statement from time to time as may be necessary or desirable in connection with our legitimate business interests, e.g. changes to the Regulations, service offerings or company policies and procedures. Disclosure of personal data CAE may disclose personal data in order to comply with legal requirements (e.g. in relation to audits, investigations or consultations with competent authorities and social security agencies), to respond to demands or to protect the interests of individuals. Disclosures shall be made in accordance with the Regulations. CAE may share your personal data with affiliated group companies where required in the context of the contractual arrangement. These entities may either be within the EU or outside of the EU, in which case CAE will only share personal data if that entity is established in a country to which an “adequacy finding” applies or if such entity has signed a contract with CAE for processing personal data in compliance with the Regulations. Data analytics (subject to any personal data being anonymised) may be shared with airline operators and relevant third parties in order to improve training services and curriculum. Further information can be provided by CAE upon request. Protection of personal data CAE regards your personal data as an asset that must be protected. We are committed to ensuring that your personal data is stored securely, only accessible by authorised persons and only transferred in accordance with this Privacy Statement and based on the implementation of appropriate technical and organisational measures in compliance with the Regulations. Nonetheless there are third parties that may unlawfully try to access systems or intercept transmissions or communications containing personal data. CAE continuously uses efforts in line with industry standards to protect personal data but cannot absolutely guarantee that such unlawful actions will not occur. CAE has in place a data breach response plan. CAE does not sell your personal data. Rights of data subject As a data subject whose personal data is processed by CAE for the Purposes, in applicable circumstances, you have the right to access your personal data, request a copy of your personal data and request to update or correct your personal data held by CAE. You also have the right to object to the processing of your personal data by CAE, to restrict the processing or request that CAE erase your personal data, all on the grounds set out in the Regulations. Note in particular your right to object against the processing of your personal data for marketing purposes. CAE will respond to any such requests in accordance with the Regulations. To the extent that the processing of your personal data by CAE is based on your consent, you have the right to withdraw such consent. Such withdrawal will not restrict CAE in continuing to process personal data if the justification therefor does not rely on your consent and is still necessary for the mentioned Purposes. You have the right to lodge a complaint with the competent personal data protection authority if you believe that the processing of your personal data is not in compliance with Regulations, or if CAE does not respond to your requests in a timely and/or appropriate manner, or if they are not answered at all. CAE will only store your personal data for the necessary duration and the Purpose(s) for which it was collected and only in a manner permitted by the Regulations or other applicable laws.
